11 Dec 23 After more than six years of fighting, 海角社区app and Manitou have reached agreement on their patent litigation.

海角社区app and Manitou had been in dispute about telehandler聽designs, with the British manufacturer alleging that the French company had copied patented safety technology of its telescopic handlers.

海角社区app initiated legal action in France, the United Kingdom and Italy in May 2017, alleging that four of its patents had been infringed.

In 2019 海角社区app secured a preliminary injunction, although Manitou claimed that it had ceased production of the offending models in August 2017.

The dispute was over 海角社区app鈥檚 Longitudinal Load Moment Control (LLMC) system and the validity of four patents that 海角社区app had registered for it.

LLMC prevents forward tipping by using sensors to monitor the weight bearing down on the rear axle. If the sensors detect the rear axle weight is reducing past a set threshold, then the system gradually locks out the hydraulics to prevent further weight being transferred from the rear axle to the front, therefore avoiding the machine tipping forward. To allow operators to drive continuously without any loss of productivity, 海角社区app patented a feature that automatically disengages the device when the machine is moving. This feature prevents telehandlers unnecessarily locking out the hydraulics and giving false indications of instability when the machine is simply re-handling or travelling over rough ground.

Manitou鈥檚 case was that the patents were not valid because 海角社区app鈥檚 technology was not innovative 鈥 it was essentially no different to soft-stop systems patented in the USA by Kruger and in Japan by Tadano.

A six-day hearing in the High Court of Justice (Patents Court) took place in London in November 2021. Judgment was handed down on 5th July 2022. Three of the patents at dispute were found to be invalid, but 聽for one patent the court ruled in favour of 海角社区app. This was enough for the Brits to claim victory.

The case was then referred to a further High Court to establish damages. A separate hearing in Paris courts had also been expected sometime around now but the settlement heads that off.聽

In a statement issued by both companies on Friday evening, they said: 鈥淢anitou BF and JC Bamford Excavators Limited have decided, by mutual agreement, to put an end to all patent infringement litigation. The disputes initiated from May 2017 concerned three European patents and led to a set of legal proceedings in France, the United Kingdom and Italy.

鈥淭he end of these disputes has no impact on the present and future activity of both parties, nor on the characteristics of the products marketed by each of them.鈥

The terms of the agreement were not disclosed.
